JULY 16, 2021

Signing of the memorandum of understanding between the National Bar Association and the International Organization for Migration (IOM), aimed at promoting the culture of legality and respect for the rights of migrants, including through the development of responsible behavior of the operators of the jurisdiction involved, as well as promoting the joint implementation of information and training initiatives. One of the objectives of the agreement is to raise awareness on the subject via specific training, facilitated by the recent approval of the decree on specialisation which identified human rights as a specific training profile. This is a commitment in the field of human rights that will allow lawyers to have the tools and weapons to give contemporary answers to a contemporary phenomenon.  It is also an opportunity to give a more complete response and allow lawyers to be allies in the challenge that immigration poses to us. The program will be implemented through the establishment of a coordinating committee consisting of four members, two appointed by the CNF (Franceso Caia and Anton Giulio Lana) and two by the IOM (the Director of the Mediterranean Coordination Office, Laurence Hart, and the Project Development Officer).

The Unione forense per la tutela dei diritti umani has given its patronage to the ceremony in memory of Ebru Timtik, an event organized by the Friulian Bar Association and held before the Court of Udine. The purpose of the event was to remember the story of Ebru Timtik, a Turkish lawyer, arrested together with her sister Barkin Timtik, after they had both suffered many persecutions due to their legal advice given to political dissidents accused of terrorism. Timtik died following a hunger strike undertaken with the aim of obtaining a fair trial. Both sisters are recipients of the 2020 Ludovic Trarieux Prize.

Conference: “Intelligenza artificiale e diritti umani” for the 30th anniversary of the quarterly scientific journal “I diritti dell’uomo. Cronache e battaglie”. The conference was attended by professors and experts who spoke about the use of artificial intelligence and new technologies. The ceremony, held at the Sala Zuccari of the Senate, was opened by Giovanni Salvi, Attorney General of the Supreme Court, and Prof. Anton Giulio Lana, President of the Unione forense per la tutela dei diritti umani. The event was moderated by Giorgio Zanchini, radio journalist and deputy editor of the journal, while the speakers were Maria Chiara Carrozza, Professor of Industrial Bioengineering at the Scuola Superiore di Sant’Anna, Lorenzo D’Avack, Professor and President of the National Committee for Bioethics, Filippo Donati, Professor of Constitutional Law at the University of Florence, Ugo Ruffolo, Professor of Private Law at the University of Bologna, and Lucia Tria, President of Section of the Supreme Court of Cassation. The event, which was streamed in order to ensure participation in compliance with COVID-19, also received the patronage of Rai per il Sociale, as well as the recognition of the Medaglia di Rappresentanza of the President of the Italian Republic.

Strasbourg, Joint Proposal for Third Party Intervention before the European Court of Human Rights (UFDU-FIDH). The Unione forense per la tutela dei diritti umani (UFDU) and the Fédération Internationale pour les Droits Humains (FIDH) have submitted a joint request for third-party intervention, pursuant to Article 36 ECHR, to the European Court of Human Rights. The request to submit observations as amicus curiae, concerned 10 complaints brought by some migrants from Italian reception centers, about the lack of respect of adequate standards in hotspots, according to European and international law. UFDU and FIDH intended to prove that the aforementioned practices violated the ECHR and in particular Articles 3, 5 and 13 and Article 4 of Protocol 4 of the Convention.

SEPTEMBER 24, 2020

On September 24, 2020, the jury for the award of the 2020 Ludovic Trarieux International Prize met in Geneva. The jury is composed of 28 European lawyers, representing lawyers from all over Europe. Lawyer and professor Anton Giulio Lana, President of the Unione forense per la tutela dei diritti umani, and Lawyer Alessio Sangiorgi, member of the Executive Board of the UFDU, were appointed as members of the jury representing the association. This year, the Prize was jointly awarded to Ebru and Barkin Timtik, two Turkish sisters and lawyers who were arrested in 2017 after much persecution due to their legal advice given to political dissidents accused of terrorism. After years of trials and pre-trial detention, Ebru Timtik went on a hunger strike demanding a fair trial, which resulted in her death after 238 days of protest. Her sister, Barkin Timtik is currently in prison, while her case is still pending before the Court of Cassation.

JULY 7, 2020

Strasbourg, Communication to the Italian State from the European Court of Human Rights. Following the discriminatory advertisement published by the local newspaper Porta Portese in 2006 and 2007, where owners and employers expressly excluded immigrants and foreigners from their offers, UFDU took the case to the European Court of Human Rights in 2012. In its appeal, UFDU claimed that the Italian State is in violation of the ECHR for the failure of the judicial authorities to condemn the discriminatory nature of the ads. The case is pending before the Court. On July 7, 2020, the Italian Government was invited to submit written observations on the matter.

Lawyer and professor Anton Giulio Lana was invited as President of the UFDU, which was recognized as one of the most representative specialized associations according to the register of the CNF in 2013. Furthermore, UFDU includes the offering of specialized training in the field of international protection of human rights among its founding purposes.

Bolzano, VII Congresso Giuridico Distrettuale “Le sfide dell’avvocatura tra riforme e intelligenza artificiale“. The most recent reforms on trials, professions and work were discussed in depth. The event received the patronage of the National Bar Association, the Unione Triveneta and the University of Bolzano. Lawyer and professor Anton Giulio Lana, as President of UFDU and expert in immigration law, offered his contribution by coordinating the section dedicated to immigration and presenting a report entitled “La giurisprudenza della Corte Europea in materia di immigrazione e i discorsi di odio”.

Udine, Seminar “Violenza di genere e violenza all’infanzia” organized by Consultorio Familiare Udinese Onlus, a solidarity-based and non-profit organization that offers health, psychological and legal services and performances. Given the relevance of the topic and the proximity to the civil battles that UFDU has always led, the latter has recognized its patronage to the event.

Genoa, UFDU, under the patronage of the Council of the Bar Association of Genoa, presented the Roundtable “L’avvocato internazionalista nella difesa dei diritti davanti al Giudice interno e alle Corti internazionali”. The central theme of the meeting was the role of the internationalist lawyer in the legal world. Moreover, the School of Advanced Specialisation for International Lawyers        organized by UFDU was officially presented.

Florence, UFTDU, in collaboration with the Foundation for Legal Training of the Bar Association of Florence, presented the Roundtable “Il diritto all’equo processo tra diritto europeo e Costituzione italiana”.

Milan, Roundtable “Cinquant’anni di spazio giudiziario Europeo”. The event, organized by the UFDU and sponsored by the Bar Association of Milan. The event aimed to examine the role of the internationalist lawyer in the legal world. Moreover, the School of Advanced Specialisation for International Lawyers organized by UFDU was officially presented.

Rome, UFDU organized the round table entitled “La procedura di ricorso individuale alla Corte europea dei diritti dell’uomo: le novità e le prospettive di riforma”. The event provided an opportunity to explore the procedural innovations introduced by Protocols 15 and 16 to the European Convention on Human Rights, including the reduction of the time limit within which to file an appeal and the opportunity to use negotiated procedures in order to reach a compromise between the parties as an alternative to court proceedings.
